Data Protection Legislation

Article 35 of the Portuguese Constitution provides for data protection as a fundamental right

Law No. 41/2004, of August 18, transposes Directive No. 2002/58/EC, of the European Parliament and the Council, into Portuguese national law. This Law concerns the processing of personal data and the protection of privacy in the electronic communications sector.

The GDPR Enforcement Act ensures the implementation of the GDPR in the Portuguese legal system and defines specific data protection rules applied to Portugal.

The General Data Protection Regulation (GDPR) is a European Union legislation that aims to protect people's rights in relation to the processing of their personal data and promote the free flow of such data.
